@element the goal of having an in-country representative by many oppressive regimes, but lately also in the EU, is that they have a 'hangman' to throw in jail or extort you with, should you not co-operate with their wishes and demands.

Banning element because terrorists are using it is like banning iPhone by the same logic. Just like an iPhone can connect to any mobile network/provider using a sim card, element can connect to any matrix server/provider.
